Privacy Policy

This Privacy Policy applies to all personal information collected by Unaudited (we, us or our) via the website located at www.unaudited.com.au (Website). We are committed to handling your personal information in accordance with the Privacy Act 1988 (Cth) and this Privacy Policy.

1. What information do we collect?

The kind of Personal Information that we collect from you will depend on how you use the Website.

We collect personal information such as your name, email address and metadata (including device information, browser type, IP address, and usage analytics collected via a third-party product analytics service). We do not collect any payment details, as our publication does not process transactions.

This information is collected when you subscribe to our publication, leave comments, contact us, send us a tip, or otherwise interact with our Website.

You do not need to provide any personal information to read the Website. If you choose not to provide it, you will not be able to subscribe, receive our emails or leave comments.

2. Types of information

The Privacy Act 1988 (Cth) (Privacy Act) defines types of information, including Personal Information and Sensitive Information.

Personal Information means information or an opinion about an identified individual or an individual who is reasonably identifiable:

  1. whether the information or opinion is true or not; and
  2. whether the information or opinion is recorded in a material form or not.

If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as Personal Information and will not be subject to this Privacy Policy.

Sensitive Information is defined in the Privacy Act as including information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive Information will be used by us only:

  1. for the primary purpose for which it was obtained;
  2. for a secondary purpose that is directly related to the primary purpose; or
  3. with your consent or where required or authorised by law.

3. How we collect your Personal Information

  1. We may collect Personal Information from you whenever you input such information into the Website or provide it to us in any other way.
  2. We may also collect cookies from your computer which enable us to tell when you use the Website and also to help customise your Website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies. Section 7 explains more.
  3. We generally do not collect Sensitive Information, but when we do, we will comply with the preceding section.
  4. Where reasonable and practicable, we collect your Personal Information from you only. However, sometimes we may be given information from a third party. In cases like this, we will take steps to make you aware of the information that was provided by a third party.

4. Purpose of collection

  1. We collect Personal Information to provide you with the best service experience possible on the Website and to keep in touch with you about developments in our publication.
  2. We customarily only disclose Personal Information to our service providers who assist us in operating the Website. Your Personal Information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties.
  3. If you subscribe, you consent to receiving our articles and occasional updates about Unaudited by email. We only send you material of a type you would reasonably expect to receive from us, and we do not use Sensitive Information in any direct marketing. Every email includes an unsubscribe link, and you can opt out at any time by using it or by emailing hello@unaudited.com.au.
  4. We do not sell your Personal Information, and we do not use it for advertising.

5. Tips and confidential sources

  1. If you send us a tip, documents or other information, we will use it only for the purpose of our reporting.
  2. We will endeavour to keep your tips and your identity confidential. We do not name sources without their consent.
  3. Access to tip material is restricted to the people who need it for our reporting, and we keep it only for as long as it is needed for that purpose.
  4. Material you send us may contain personal information about other people. We handle that information with the same care as information about you, and we assess its accuracy and relevance before relying on it.
  5. Sending information to a journalist is not automatically a protected disclosure under the whistleblower provisions of the Corporations Act 2001 (Cth). If statutory protection matters to you, you should get independent legal advice before you contact us. Our Tips page has more guidance.

6. People we write about

  1. Our articles may refer to company directors, executives and other individuals. That information is drawn primarily from public records, including ASX announcements, company filings, ASIC records and court and tribunal records.
  2. We collect, use and publish this information in the course of journalism. Where it applies, we rely on the journalism exemption in section 7B(4) of the Privacy Act, and we are committed to observing the privacy standards set out in this Privacy Policy in our journalism.
  3. If you are referred to in an article and believe something about you is inaccurate, contact us at hello@unaudited.com.au. Our Disclosures page explains how corrections and right of reply work.

7. Cookies and analytics

  1. We use cookies and similar technologies to keep you signed in, to remember your preferences, and to understand how the Website is used through a third-party product analytics service.
  2. We do not use cookies to serve advertising, and we do not run advertising on the Website.
  3. If you do not want information stored in cookies, you can block or delete them in your web browser's settings. Some features, such as staying signed in, may not work properly if you do.

8. Security, access and correction

  1. We store your Personal Information in a way that reasonably protects it from unauthorised access, misuse, modification or disclosure. When we no longer require your Personal Information for the purpose for which we obtained it, we will take reasonable steps to destroy and anonymise or de-identify it.
  2. Subscriber details are kept for as long as you remain subscribed. If you unsubscribe or ask us to delete your details, we will take reasonable steps to delete or de-identify them, unless we are required by law to keep them.
  3. The Australian Privacy Principles:
    1. permit you to obtain access to the Personal Information we hold about you in certain circumstances (Australian Privacy Principle 12); and
    2. allow you to correct inaccurate Personal Information subject to certain exceptions (Australian Privacy Principle 13).
  4. Where you would like to obtain such access or make a correction, please contact us in writing at hello@unaudited.com.au. We may ask you to verify your identity before we act on the request, and we will respond within a reasonable time.
  5. If we refuse a request for access or correction, we will tell you in writing and give our reasons.

9. Minors

The Website is not directed at people under 18, and we do not knowingly collect their Personal Information. If you are a parent or guardian and believe we hold Personal Information about a person under 18, contact us at hello@unaudited.com.au and we will delete it.

10. Complaint procedure

If you have a complaint concerning the manner in which we maintain the privacy of your Personal Information, please contact us at hello@unaudited.com.au. All complaints will be considered by Unaudited and we may seek further information from you to clarify your concerns.

If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner:

11. Overseas transfer

We use third-party service providers to host the Website, send our emails and provide analytics. Some of these providers store or process information overseas, including in the United States, so your Personal Information is likely to be transferred to or stored in the United States. Other countries may also be involved, depending on where those providers operate.

If your Personal Information is sent to a recipient in a country with data protection laws which are at least substantially similar to the Australian Privacy Principles, and where there are mechanisms available to you to enforce protection of your Personal Information under that overseas law, we will not be liable for a breach of the Australian Privacy Principles if your Personal Information is mishandled in that jurisdiction.

If your Personal Information is transferred to a jurisdiction which does not have data protection laws as comprehensive as Australia's, we will take reasonable steps to secure a contractual commitment from the recipient to handle your information in accordance with the Australian Privacy Principles.

12. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The current version will always be available on the Website, with the date it was last updated shown at the top.
